“El pedido de autos solicitados por esta Corte no suspende el juicio oral en trámite, ni hubo decisión alguna del Tribunal Oral en ese sentido”, sostuvo el tribunal presidido por Carlos Rosenkrantz.
A través de de un comunicado, la Corte Suprema explicó que “la medida es al sólo efecto de examinar la causa que, una vez extraídas y certificadas las copias pertinentes, será devuelta a dicho tribunal, en tiempo oportuno”.
Asimismo, señaló que “existen ante el Tribunal, además de la causa de referencia, un total de ocho recursos más que fueron deducidos por las partes en el marco de la causa principal” y que “todos” están en trámite.
“El paso jurídicamente correcto fue solicitar los incidentes de la Cámara Federal de Casación Penal al Tribunal Oral Federal interviniente, que fueron recibidos por el Tribunal en fecha 17 de abril de 2019”, agregó.
Según sostuvo, “de la lectura de dichos legajos no surgieron elementos suficientes para poder resolver los planteos de las partes”.
“En función de ello se solicitó con carácter de urgente el expediente principal al Tribunal Oral, medida ésta dispuesta por esta Corte Suprema”, indicó la Corte Suprema.
En el comunicado también se precisó que “esta medida es habitual en la Corte y ha sido adoptada en numerosas oportunidades”.
“Esa decisión no tiene firma alguna de los ministros ni disidencias, y se concreta con la sola firma del secretario, tal como es de estilo y como fuera oportunamente publicado”, precisó.
Tras aclarar que el pedido del expediente “no suspende el juicio oral en trámite”, aclaró que “podrán satisfacerse simultáneamente por un lado la necesidad de que los procesos judiciales en temas tan delicados avancen, y por el otro, el respeto del derecho de defensa de los imputados”.
“De este modo se evitará reincidir en anteriores experiencias jurisdiccionales en las que por no haber ejercido un control oportuno los procesos llevados adelante culminaron nulificándose por deficiencias procesales no atendidas en su debido momento, generando desconfianza en la sociedad”, agregó.
El comunicado de la Corte se conoció luego de que el Tribunal Oral Federal 2 dispusiera remitir la causa por fraude en la obra pública al máximo órgano del Poder Judicial.
Antes de la aclaración de la Corte, el presidente del TOF 2, Jorge Gorini, había aclarado que “no fue suspendido” el juicio por presuntas irregularidades en la obra pública contra la ex mandataria Cristina Kirchner.
“El juicio hasta el día de hoy (jueves) se mantiene. Tiene fecha de inicio para el martes 21 de mayo, fecha que todavía no fue suspendida. El juicio no fue suspendido”, había manifestado el magistrado.
En diálogo con Radio La Red, Gorini había precisado que “el requerimiento de la Corte de elevación de la causa principal es en términos de urgencia con lo cual también se entiende que con carácter de urgencia se va a extender al tratamiento de las cuestiones para lo cual la Corte ha requerido la causa”.
La causa principal fue requerida para que se resuelvan nueve recursos que están en estudio de la Corte Suprema a instancias de presentaciones realizadas por las partes.
“Estamos en contacto con la Secretaría General de la Corte, trabajando para garantizar los derechos de las partes y a su vez ofrecer las condiciones de debido proceso y agilidad de la Justicia, por eso es que el juicio hoy no está levantado”, expresó Gorini.
De todos modos, el presidente del Tribunal había explicado que el juicio no podría desarrollarse sin el expediente materialmente en el TOF ya que no podría hacerse referencia a fojas que no están.
“No podría realizarse el juicio de no tener devuelto el expediente de parte de la Corte conforme lo ha querido”, había señalado.
